Who Can Put a Lien on Your House Without You Knowing?

What is a Lien?

A lien is a legal claim against your property because of a debt that you owe. It gives someone else the right to claim your home as collateral. Not all liens are created equal, though. Some are voluntary, like your mortgage, which you agreed to when you took out the loan. But others—like tax liens or mechanic’s liens—can be placed on your property without your consent, and these are the ones that could threaten your home.

The Most Dangerous Liens

  1. Tax Liens: Owe property taxes or income taxes? The government can file a lien against your property without warning, and if you don’t pay up, they can take your home and auction it off to cover the debt.
  2. Mechanic’s Liens: If you’ve ever hired a contractor and didn’t fully pay them, even if you’re disputing the work, they can file a mechanic’s lien on your house. Imagine discovering this only when you’re about to sell!
  3. Judgment Liens: These occur when a creditor, like a credit card company or hospital, sues you for unpaid bills. If they win, they can place a lien on your home, giving them the right to claim your property.
